Court denies bail to Congress leader; says people who stay in India must be faithful to it

A Congressman  was denied bail by the Gujarat High Court after he was accused of uploading offensive material online, including “anti-India” and “pro-Pakistan” comments on Facebook. The court rejected Afzal Lakhani’s request for bail, saying that people who stay in India must be faithful to the country.

Afzal Lakhani was denied bail by the Gujarat High Court after being charged of tweeting offensive comments on Prime Minister Narendra Modi and his deceased mother.

Justice NS Desai rejected Lakhani’s request for bail, saying that “People who stay in India must be faithful to India.”
Live Law said that Lakhani also allegedly uploaded offensive material on social media sites criticizing Prime Minister Narendra Modi and his deceased mother Hiraba.

The court said, “People may have personal ‘likes’ or ‘dislikes,’ but it does not imply that they may use insulting and vile words against the Prime Minister of the nation and his late mother. This distinction between ‘liking-disliking’ and ‘personal assault’ is important.

The court additionally ruled in its judgment that it was impossible to repeat any of the posts because of how insulting and disparaging the terms used in them were.

According to the Gujarat Police’s chargesheet against Lakhani, he is accused of fabricating his identity and creating 18 Facebook sites where he authored and shared stuff that was disparaging of India and had a sectarian tone.

Lakhani targeted a specific community in the posts in addition to posting offensive material against Prime Minister Narendra Modi and his deceased mother Hiraba.

Additionally, the Gujarat state attorney said that Lakhani made calls to Pakistan and uploaded pornographic information on Facebook.
Lakhani had already been charged by the Jamnagar Police with many offenses under the Indian Penal Code (IPC) in January 2023.
