ITC rejects Apple’s request to suspend Watch Series 9 and Ultra 2 import & sales restriction

The US International Trade Commission (ITC) rejected Apple’s request to suspend an import and sales restriction on its Watch Series 9 and Watch Ultra 2 in the US. The ITC had earlier found that Apple’s SpO2 sensors violated Masimo’s patents.

Apple’s request to halt its US Watch Series 9 and Watch Ultra 2 import and sales restriction was rejected by the ITC. The ruling is part of a patent battle with Masimo over the Watch’s blood oxygen sensor technology.

The import restriction starts on December 26 and Apple shops will sell the impacted watches until December 24. The ITC found in October that Apple’s SpO2 sensors violated Masimo’s patents.

Apple was sued twice by pulse oximeter maker Masimo for violating its technology. The US Series 9 and Ultra 2 prohibition does not effect foreign sales. Apple is purportedly updating the Watch’s oxygen saturation software.

US President Joe Biden can reject the ITC import restriction judgment during presidential review. Apple strongly disagrees with the ruling and is investigating legal and technical measures to keep the Apple Watch available.

The patent battle involves Apple’s SpO2 sensors, which detect blood oxygen. The prohibition may hurt US sales, but Apple is working to satisfy Masimo’s worries. The presidential assessment will establish the import ban’s ultimate status, which might affect Apple’s Watch Series 9 and Watch Ultra 2 in the US.
