Class 12 students who studied physics, chemistry, biology, or biotechnology in addition to English from recognized boards can take the NEET-UG exam. This judgment applies to students whose applications were declined, the National Medical Commission (NMC) announced on Wednesday.

The old Medical Council of India (MCI) supervised MBBS admission and selection under Chapter-II of the Regulations on Graduate Medical Education, 1997, with various changes.

In the public announcement, the NMC Undergraduate Medical Education Board stated that candidates must have completed two years of regular or continuous study of Physics, Chemistry, Biology, or Biotechnology in Class 11 and 12 with practical, along with English.

The two-year study had to be done in conventional schools, not open or private.

The notice further said that Biology, Biotechnology, and other required subjects may not be taken after Class 12.

The Delhi High Court overturned the provisions on May 11, 2018, in a case and other concerns.

This affected candidates seeking admission in graduate and primary medical courses in foreign medical institutes due to the eligibility requirement for taking admission in an Undergraduate Medical Course in a Foreign Medical Institution Regulations, 2002 and the Screening Test Regulation, 2002.

In this context, applicants were disqualified from NEET-UG and their eligibility certificate applications were denied.

The Graduate Medical Education Regulations, 2023 were notified by the NMC on June 2.

NEET-UG candidates must have passed 10+2 or its equivalent with Physics, Chemistry, Biology / Biotechnology, and English, under Regulation 11(b).
“Therefore, after the framing of Graduate Medical Education Regulations, 2023 the earlier Regulations on Graduate Medical Education, 1997 including the various amendments stand repealed prospectively,” the NMC added.

In a June 14, 2023 meeting, the NMC considered the New Education Policy, which allows Class 12 students to study many courses freely.

It “decided that the previous approach of the erstwhile Medical Council of India needs to be revisited by permitting candidates to undertake study of the requisite subjects (Physics, Chemistry, Biology / Biotechnology alongwith English) even as additional subjects after passing Class 12th from duly recognised boards by the concerned Government” .

The announcement added that such applicants can take NEET-UG and receive an eligibility certificate.

The present decision applies retrospectively to candidates whose eligibility certificate applications were rejected for the reasons stated the public notice. Candidates who become eligible after the public notice date can take NEET-UG-2024.

Further, MCI/NMC court suits filed in any court in this regard should be withdrawn, and all outstanding litigations filed by candidates against MCI or NMC shall be explained with the current public notice to be resolved as soon as possible.

On June 14, 2023, the NMC decided to revisit the erstwhile Medical Council of India’s approach by allowing candidates to study Physics, Chemistry, Biology / Biotechnology, and English as additional subjects after passing Class 12th from government-recognized boards.

The present decision applies retrospectively to candidates whose eligibility certificate applications were rejected for the reasons stated the public notice. Candidates who become eligible following the public announcement can take NEET-UG-2024.
