A court has fined the Registrar of Companies (RoC) due to an unjustified delay on their behalf, violating Rule 10(1) of the 2014 Rules. The RoC will now have to pay Rs 25,000.
The Registrar of Companies (RoC) has been asked to pay a fine of Rs.25000 by the Calcutta High Court. In the ruling, Justice Moushumi Bhattacharya stated that the RoC must pay the petitioner Rs 25,000 within a week because of the apparent and unjustified delay on their behalf, which was also in violation of the rule under Rule 10(1) of the 2014 Rules. Adventz Finance filed the lawsuit.According to the ruling, it seems that the petitioners submitted the e-form again after receiving a request to resubmit it with specific information. The petitioners object that the ROC did not act after August 5, 2021, and that the details that the petitioners were supposed to resubmit were not included in the impugned letter from the ROC dated July 29, 2022. It is clear that the ROC has been sitting on the second submitted charge since 2021 without doing anything about it, according to the statement.
It said the Registrar must take a decision on an e-form or document within 30 days from the date of its filing (Rule 10(1) provision.
