SC warns Patanjali against making false claims about its medicines; may impose heavy fine

On Tuesday, the Supreme Court warned Patanjali Ayurved, a herbal products firm co-founded by yoga guru Ramdev, against making “false” and “misleading” claims in its ads about curing different diseases. “Patanjali Ayurved must halt its deceptive ads. The court will take any such breach very seriously “While hearing an IMA plea, judges Ahsanuddin Amanullah and Prashant Kumar Mishra verbally stated.

On August 23, 2022, the top court issued notifications to the Union Health Ministry, Ministry of Ayush, and Patanjali Ayurved Ltd. on the IMA’s claim that Ramdev slandered the vaccination drive and modern medicines.

The bench asked Patanjali Ayurved not to disseminate deceptive claims and advertisements against modern medicine during the brief hearing.

It added the bench may punish every product Rs 1 crore if it falsely claims to cure a disease.

The top court urged the Centre’s counsel to find a solution to misleading medical ads that claim drugs cure specific conditions perfectly.

Next February 5, the bench will hear IMA’s plea.

In its plea papers, the top court chastised Ramdev for attacking allopathy and allopathic practitioners, adding he should not abuse doctors and other treatment methods.

“What became to Guru Swami Ramdev Baba?… He popularized yoga, thus we appreciate him. All go for this. He shouldn’t criticize the other system. What guarantees that his Ayurveda approach will work? IMA cited various advertisements that purportedly portrayed allopaths and doctors negatively, alleging that ayurvedic medication manufacturers have used “disparaging” claims to deceive the public.

The IMA counsel claimed these adverts claim doctors are dying despite modern treatment.

IMA said it was working to prevent vaccinations, particularly the COVID-19 program, and allopathic medical use.
